In this essay will there be an analysis and comment on the article “Babies in Limbo: Laws Outpaced by fertility Advances”. The article is written by Rick Weiss and published in Washington Post Staff Writer in February 1998. In the essay will be a focus on how the reporter attracts the attention of his reader and the factors that have caused this crisis in reproductive medicine. The last focus deals with how the title matches the article and the article’s problem. The big problem in the whole article is the fact that USA doesn’t have a common law about fertility advances.

To clarify the factors that have caused the crisis in reproductive medicine, I have chosen to focus on 3 of the most important factors. One of the factors that have caused the crisis in reproductive medicine is the cases the reporter uses in the article. The cases are about surrogate mothers who help other people there can’t get children on their own and how the people treat the children. Beyond this some of the other cases are about the fact that some children actually have several parents than two. “Courts are also finding themselves embroiled in debates over fertility clinic record-keeping practices, which in some cases appear to have led to the loss of women’s frozen embryos.” (Page 2 line 54-56). This quotation supports the factor about surrogate mother and buying of eggs and sperm. But the quote also shows the fact that a law about fertility advances are missing in the whole USA. But this quote also supports the factor about the uncertain methods. Another factor that has caused the crisis in reproductive medicine is the uncertain methods about artificial insemination with and out other women’s eggs and surrogate mothers. The women don’t know if the sperm has diseases or if the egg from the other woman has. They can also risk there is several of donors in the egg or the sperm. “New treatments are being rushed into use before they are fully proven to be safe or effective, potentially putting some women and children at heightened risk of physical and psychological harm.” (Page 2 line 43-45). The quotation shows how uncertain the methods are about the fertility advances. The women can get physical and psychological harm, because the methods are uncertain. And the same thing finds place in the fertilisation because the woman can risk that the children have several of parents.The last factor that has caused the crisis in reproductive medicine is the missing common law and the liberalism. USA uses the liberalism a lot. The people think that the system doesn’t have the power to makes law about stuff there is close to them. USA doesn’t have a common law about fertility advances. It is the individual state who makes law to them self. “A similar number of states require a husband’s permission before a married woman can accept donor sperm. Almost every state has laws to clarify who the legal father is when donor sperm are used. Five states have laws regulating egg donation.” (Page 3 line 16-19). This quotation shows the main problem in the article. The missing common law about fertility advances. But it also shows that in some states are laws about fertility advances and in other states are there not are a law about fertility advances. You can also see that the reporter want the USA to have a common law about fertility advances. “Are intensely personal and essentially private matters which are appropriately resolved by the prospective parents rather than the courts.” (Page 3 line 80-81). The quote shows the people in USA don’t want the system to decide thing they want to do in their life.
